CloudPort Terms of Service

1. Scope of Services
CloudPort provides international shipping, tracking, logistics coordination, fulfillment support, and related services. These Terms govern access to and use of the CloudPort platform, website, account features, shipment workflows, and support tools.
2. Account Registration
To use certain features, you must create an account. You agree to provide accurate information, maintain the security of your account, and notify CloudPort promptly if your account details change or if unauthorized access occurs.
3. User Responsibilities
Users are responsible for the accuracy and completeness of shipper and recipient information, package details, customs information, and payment information submitted through the platform. Users must ensure they are authorized to provide any third-party information submitted to CloudPort.
4. Pricing and Quotes
Quotes are estimates based on information provided at the time of request. Final charges may vary depending on package characteristics, customs requirements, service changes, surcharges, or operational conditions. CloudPort may update pricing or fees as required by service conditions or provider rules.
5. Shipment Acceptance
CloudPort may refuse, suspend, or cancel any shipment if it is unsafe, prohibited, improperly described, non-compliant with laws, insufficiently documented, or otherwise unsuitable for the relevant service. Shipment acceptance is subject to carrier, customs, and operational constraints.
6. Customs and Regulatory Compliance
Users are responsible for ensuring that goods, documents, and customs declarations comply with applicable customs, export, import, tax, and trade laws. CloudPort may require information necessary for customs clearance and may share relevant details with logistics partners or government authorities as needed.
7. Payment Terms
Charges for CloudPort services must be paid in accordance with the selected service and billing method. CloudPort may suspend services or shipments for unpaid balances, and users remain responsible for any fees, penalties, or additional costs arising from their shipments.
8. Tracking and Notifications
CloudPort provides shipment information and delivery updates in good faith, but tracking data may be delayed, incomplete, or affected by operational events, carrier systems, customs processes, or third-party delays. CloudPort does not guarantee real-time precision for every event.
9. Delivery and Exceptions
Delivery times are estimates only. Delays may occur due to weather, customs, carrier limitations, operational issues, or other circumstances outside CloudPort's reasonable control. Users must address delivery exceptions, failed attempts, or customs issues promptly.
10. Liability Limits
CloudPort is not liable for indirect, incidental, consequential, or punitive damages arising from shipments, delays, missed delivery estimates, customs issues, service interruptions, or third-party logistics actions, except to the extent required by applicable law.
11. Prohibited Goods
Users may not use CloudPort services to ship prohibited, dangerous, restricted, illegal, or non-compliant goods. CloudPort may refuse or report any shipment that appears unlawful or unsafe, and users remain responsible for compliance with all applicable laws.
12. Intellectual Property
CloudPort content, branding, interface design, text, and software are protected by intellectual property rights. Users may not reuse, copy, distribute, or reproduce CloudPort materials without prior written permission, except as permitted by applicable law or the platform's published functionality.
13. Privacy and Data Handling
CloudPort processes personal and shipment information in accordance with the CloudPort Privacy Policy. By using the Services, you consent to the collection, use, disclosure, and retention of data described in that policy, subject to applicable legal requirements.
14. Platform Changes and Service Availability
CloudPort may modify features, pricing, services, support options, or delivery methods at any time. Service availability may vary by region, shipment type, or operational conditions. Continued use of the platform indicates acceptance of any changes affecting the Services.
15. Termination
CloudPort may suspend or terminate access to the Services for misuse, non-compliance, abusive usage, repeated payment issues, or other conduct that threatens the integrity or security of the platform. Users may also cease using the Services at any time.
16. Governing Law and Disputes
These Terms are governed by the laws of the jurisdiction in which CloudPort operates, unless another specific agreement applies. Users agree to resolve disputes through the available legal channels under applicable law, and any claims must be brought within the time allowed under applicable law.
